Eligibility:
The “HBF Textiles Matriarch Pillows Sweepstakes” is open to anyone who has a valid Instagram® account and follows HBF & HBF Textiles. Participants must be a U.S. resident and at least 18 years of age at the time the sweepstakes begins. The “HBF Textiles Matriarch Pillows Sweepstakes” (“Sweepstakes”) is void outside the United States or where prohibited or restricted by law. 

This Sweepstakes is sponsored by Hickory Business Furniture, LLC (“Sponsor”). All employees, officers, directors and agents and their immediate families or any members of their households, regardless of relationship, of Sponsor or any advertising agency or other company involved with the design, production, execution or distribution of this Sweepstakes are not eligible to participate in the Sweepstakes or to win any prizes. Instagram® is not an official sponsor of this promotion.

Any Sweepstakes entries received from an ineligible participant will be disqualified. By participating in this Sweepstakes, participants accept and agree to be bound by these rules and the decisions of the Sponsor, which shall be final on all matters. Sponsor reserves the right to modify the rules of the Sweepstakes in any way at any time, subject to state or federal law.  

Sweepstakes Period:

The Sweepstakes begins on March 9, 2023, at 8:00 a.m. CST and ends on March 16, 2023, at 11:59 p.m. CST (“Sweepstakes Period”). All entries must be received and recorded by the Sponsor during the Sweepstakes Period to be eligible. 

How To Enter:
Sponsor will create 3 posts on Instagram using #HBFTextilesMatriarch. To enter the Sweepstakes participants must (1) follow HBF and HBF Textiles on Instagram®, (2) like at least one of Sponsor’s posts, and (3) tag at least 2 people. For each post that a participant likes and tags, participant will receive 2 entries into the drawing. If a participant reposts Sponsor’s post to the participant’s stories tagging @hbftextiles and using #HBFTextilesMatriarch, participant will receive an additional 2 entries into the drawing. If a participant likes and tags all 3 posts and reposts each of Sponsor’s posts to the participant’s Instagram stories, participant can earn up to 12 entries total.  

Sponsor is not responsible for lost, misdirected, late, unsent, incomplete, illegible or unintelligible entries or for inaccurate entry information, whether caused by the participant or by any of the equipment or programming associated with or utilized in this Sweepstakes, or by any technical or human error that may occur in the transmittal of any entry or the processing of any function on the participant’s computer system.  Participant must notify Sponsor of any changed contact information within the Sweepstakes Period to remain eligible to win based on entry information.  Sponsor reserves the right, in its sole discretion, to disqualify any individual found to be tampering with the entry process or the operation of the Sweepstakes; to be acting in violation of these rules; or to be acting with intent to annoy, abuse, threaten or harass any other person. Any use of robotic, automatic, programmed, or similar response methods will void all such entries submitted by such methods.

Prize:
Sweepstakes participants will enter for a chance to win three (3) pillows in Matriarch textiles, with 8 colors to choose from.  Prize value is estimated at $350. Shipping and handling included.

Selection of Winner:

One (1) winner will be chosen at random among all eligible entries received. The chances of winning depend on the number of entries received. No transfer, assignment, cash redemption or substitution of any prize is permitted, except by Sponsor due to prize availability and then with a prize of equal or greater value.

The winner will be selected in a random drawing on March 23, 2023. Sponsor will notify the winner by direct message through their Instagram® account.

Winner must respond within five (5) days of being notified or the prize may be forfeited and another Sweepstakes participant chosen.  The winner must satisfactorily complete an affidavit of eligibility showing compliance with these Sweepstakes Rules, and must also sign a liability and publicity release, allowing Sponsor to use his or her information for advertising or other purposes.  Failure to complete these forms may result in forfeiture of the prize.  In the event that the potential winner is disqualified for any reason, the Sponsor may select an alternate potential winner by random drawing from among all remaining eligible entries.

Winner is solely responsible for all applicable federal, state or provincial, and local taxes and any expenses associated with any prizes. Where the value of a prize is $600 or more, Sponsor is required to issue a Form 1099-MISC to the winner, which winner must complete and then return a copy to Sponsor prior to the Sponsor delivering the prize.  

The Sponsor reserves the right, in its sole discretion, to modify, terminate, or suspend this Sweepstakes should viruses, bugs, unauthorized human intervention or other causes beyond Sponsor’s control corrupt or impair the administration, security or fairness of the Sweepstakes.  The Sponsor is not responsible for any human or technological error that may occur in the processing of the Sweepstakes nor are they responsible for any error, omission, interruption, deletion, defect, communications line failure, theft or destruction of, unauthorized access to, delay in operation, transmission, or distribution of, or alteration of entries, whether caused by the sender, any of the equipment or programming associated with or utilized in this Sweepstakes, or otherwise.

Limitation of Liability and Dispute Resolution

Except where prohibited, each participant and winner accepting a prize agrees that: (a) all issues and questions concerning these rules shall be governed by Iowa law without giving effect to any principles of conflicts of law of any jurisdiction; (b) any and all disputes, claims and causes of action at law or in equity arising out of or relating to this Sweepstakes or any prize awarded shall be (i) resolved individually, without resort to any form of class action; and (ii) filed only in the state courts situated in Iowa, and participant hereby consents and submits to the personal jurisdiction of such courts for the purposes of litigating any such disputes, claims or causes of action; (c) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, but in no event shall include attorneys' fees; and (d) under no circumstances will any participant or winner be permitted to obtain awards for and hereby waives all rights to claim punitive, incidental, special, consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased.
